How Surplus Recovery Works in Ohio

What Happens After a Sheriff’s Sale in Ohio

When a property sells for more than the amount owed, the extra money — called a surplus — is held by the county. Ohio law does not require the county to notify former owners or heirs. To receive these funds, you must file a request with the court.

Step 1 — The County Holds the Surplus (ORC 2329.44)

After the sheriff’s sale, the Clerk of Courts pays off debts and places any leftover money into a special account. The court does not release these funds automatically. The rightful owner or heirs must take action to claim them.

Step 2 — The Court Reviews the Claim (ORC 2329.45)

To receive the funds, the rightful owner or heirs must file a formal request. The judge reviews the claim, checks for competing interests, and determines who is legally entitled to the money.
